(2) Users understand and agree that Physicians are not liable for damages caused in the exercise of the profession: (i) when they are due to working conditions or (ii) when acting in good faith in emergency situations, with compliance with the competence granted. In the situation where a court will establish that the Doctors are not fully exonerated from liability under art. 1 above, they will be exonerated from liability on the basis of the cases of limitation of liability provided for in this article, according to art. 654 (2) of Law no. 95/2006.
(3) The users understand and accept that the Platform / Platform Administrator is not a public or private health unit, provider of medical services, therefore it cannot be held liable under art. 657 of Law no. 95/2006 or on the basis of any other legal basis.
The users understand and expressly accept the provisions provided in art. (1), (2), (3) above, according to art. 1203 Civil Code.
The rights and obligations of the Users and the Administrator of the Platform, provided by the Terms and Conditions, as well as all the legal effects that the Terms and Conditions produce will be interpreted and governed in accordance with the Romanian law in force. Any dispute arising out of or in connection with the Terms and Conditions will be settled amicably. In case of impossibility to reach an agreement, the dispute will be solved by the competent Romanian court located in the territorial area of Bucharest.
The Administrator of the Platform has the right to modify at any time and in any way any of the provisions of the Terms and Conditions or the Terms and Conditions in full, without any prior notice and without being obliged to fulfill any other formality towards Users.
